Terms of Service

These Terms of Service (“Terms”) govern your access to and use of GenWaifu.ai (the “Service”). By creating an account, purchasing credits, or generating images, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this age requirement and that you have full legal capacity to enter into this agreement.

You sign in using a third-party provider (Google, Discord, X) or an email magic link via Supabase Auth. You are responsible for safeguarding your account and for all activity occurring under it. Tell us at genwaifusupport@gmail.com if you suspect unauthorized access.

The Service is SFW-only. You agree not to:

• Attempt to bypass content filters, prompt guards, or tag restrictions designed to prevent explicit output;
• Generate images depicting minors in any sexualized context, real people without their consent, or content intended to harass, defame, or impersonate;
• Use the Service to produce content that violates applicable law in your jurisdiction or ours (Canada);
• Scrape, spider, or reverse-engineer the Service, or exceed documented queue or rate limits through automation;
• Resell credits or accounts, or circumvent the credit system.

We may suspend or terminate accounts that violate this section, with or without notice, and may retain generation history and logs for abuse investigation.

Image generation is powered by a credit system. Credits are purchased in one-time packs priced in US dollars, with taxes added per your jurisdiction at checkout via Stripe Tax. Pricing, pack sizes, and bonuses are displayed at /pricing. We reserve the right to change pricing or bonus structures; changes apply only to future purchases.

Credits do not expire for accounts that have made at least one paid purchase (“Members”). Signup-bonus credits on unpaid accounts may be subject to retention limits described at the time of grant.

Refunds: credits are non-refundable except where required by law. Stripe disputes should be directed to us first at genwaifusupport@gmail.com before initiating a chargeback — we will make reasonable effort to resolve billing errors. Failed generations (where the Service is unable to deliver an image) are not charged against your balance.

Your generations: to the extent permitted by law, you own the images you generate through the Service. You are responsible for your use of those images, including compliance with any applicable copyright, trademark, or likeness rights in the underlying prompts and characters.

Our platform: the Service software, design, trained models, curated character and prompt data, showcase gallery, and brand are owned by GenWaifu.ai or licensed to us. You may not copy, modify, or create derivative works of the Service itself.

License to us: you grant us a worldwide, royalty-free license to store and serve your generations on our infrastructure for the purpose of operating the Service, and to display images you explicitly publish to the public showcase.

The Service relies on third-party processors. See our Privacy Policy for a full list. Their terms apply to the parts of the Service they operate, and we are not responsible for their outages, breaches, or policy changes.

The Service is provided on a best-effort basis. We do not guarantee uninterrupted availability, specific generation speeds, or that any particular GPU will be online at a given time. Planned maintenance and unplanned outages may occur.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. AI generation is probabilistic — we do not warrant that outputs will match your expectations or be free of unexpected artifacts.

To the maximum extent permitted by law, GenWaifu.ai and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

You agree to defend and indemnify GenWaifu.ai and its operators against any claim arising from your violation of these Terms or misuse of generated content.

You may close your account any time by contacting us. We may suspend or terminate your account for breach of these Terms, for fraud, or for non-use. On termination, unused credits are forfeited unless refund is required by law.

We may update these Terms from time to time. Material changes will be noted at the top of this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Alberta, except where consumer protection law in your jurisdiction grants non-waivable rights to a different forum.
